Just read Paul Clement’s severability oral arguments on Obamacare.

After reading it… if Paul Clement manages to get the Supreme Court to simply just kill Obamacare outright, no excuses, no saving throw, well. We’re going to have one HECK of a confirmation fight in a few years.

    Worth noting he’s representing the House in its DOMA litigation.

  • Jbird says:

    how did Sotomeyer get confirmed?

  • BigGator5 says:

    @Jbird: Elections matter.

  • lourae says:

    Yowza. Compare and contrast: “Justice Sotomayor, I’d be delighted to discuss . . .” with “Um, ahem, *gulp* I, uh *gulp*. . ” Paul Clement–Cheney’s secret love child?

    I don’t think you understood what Moe Lane is saying. If this is overturn, Clemen will be the next Republican President’s short list for Supreme Court nomimee.

  • Darin H says:

    Wasn’t Clement on the short list already for both the Roberts and Alito picks? Anyways, I whole-heartedly would rejoice with Hallelujahs if President Romney nominated Paul Clement to the Supreme Court, especially to replace a liberal Justice.
