Barack Obama will make a (poor) recess appointment because it benefits HIM.

If Barack Obama makes a recess appointment of a Supreme Court justice – and he may be able to [UPDATE: Link fixed, sorry] – it will largely benefit just Barack Obama.  The Democrats actually would like a real fight over this, because they don’t want the precedent set that both sides are permitted to be partisan over judges.  So if Barack Obama short-circuits the entire looming fight, he is pretty much cutting off his own party’s partisans at the knees AND making them have to pretend that they really wanted this to happen, ya, you betcha.  Meanwhile the GOP will of course come out of this in decent long-term shape; we probably have some bad decisions this year, sure, but we’ll get that seat opening up next year with a new President and we stuck to our guns. Not our fault that Barack Obama thinks that he’s a king.

So, yeah, Barack Obama will back-stab his fellow-Democrats.  Who will then be forced to act as if this was a brilliant ploy. Not my optimal solution, but not the end of the world, either. [UPDATE: Or maybe he won’t,]

  1. I’m kind of glad at this point Obama is a third-rate Chicago Machine politician, and not a true operator, like Slick Willy.

    Clinton would have read the tea leaves, seen the precedents, and said, “You know what would be fun?” Then he would lob a GOPe candidate at them, someone with all the conservative impulses of Souter, for instance. Then he would watch the Senate try to explain why they couldn’t accept one of their own as a Supreme Court nominee, or get a win for his side for the next 30 years in everything but name. Either way, we’d be screwed.

    Thankfully, the petulant man-child only knows how to whine, play golf, and sulk the world doesn’t stop on its axis when he commands it to. So we won’t have to worry about him being smart.

    1. The truly vicious ploy would be to nominate Ted Cruz, but that would more or less confirm Marco Rubio as the nominee and Hillary Clinton wouldn’t thank him for that*.

      *Mind you, I like my chances against Hillary with Cruz, Rubio, and maybe even Kasich and Bush.

      1. Y’know that’s a bit of a shotgun idea…. Cruz could mention nominating Rubio and vice versa, Jeb! could shiv Cruz, etc. etc.
