A random thought about same-sex marriage.

To wit: the general consensus on this seems to be that, essentially, the US Supreme Court is going to at some point heat-treat the back of the US Constitution to expose the Gay marriage is Constitutional clause that the Founders wrote in invisible ink, lo these many years ago. Let us be clear: the Founders did not. The Founders, in fact, would have written Gay marriage is not Constitutional if any of them had had any notion that such a thing needed to be spelled out*.  That I can state that while still simultaneously supporting gay marriage is not a contradiction: after all, something doesn’t have to be enshrined in the Constitution first before it can officially be seen as being, one the whole, as a reasonably good idea.

Again, the assumption is that the USSC is going to disagree with me on this one, probably at the next available opportunity.  But what if it doesn’t?  What will happen if we get a 5-4 decision declaring that there is no Constitutional right to gay marriage – but that there is nothing in the Constitution to prevent a state from defining marriage to include same-sex couples, either?

Chaos and Old Night, probably.  Certainly social media will probably crash for a couple of hours after the decision is announced.  Followed up by a frantic attempt to Fix The Blame on somebody.  It would, indeed, be something to see.

But they probably won’t do it. Probably. Almost certainly.  Forget I even brought the possibility up.

*Yes, I know: they were also against giving women the vote and for keeping slavery around.  Note that we repaired both of those errors, and several others, with Constitutional amendments.

  1. I really do not care – stop – I do care somewhat. If gay marriage is given a USSC setback, then I will be happy. Not because I care much about gay marriage, but that I would like to see the proponents of gay marriage get punched very hard in the face.
    Because they are such jerks, because they are such bullies, because they really need more symbolic punches in the face to remind them that they have to live amongst other people; and because I would prefer symbolic punches as opposed to real punches being thrown.
    Because I think, if the Left continues as it is, there will be real punches thrown. And I suspect they will not like that at all.*
    *”You will be made to care!”
    “Bad idea; now I do care.”

    1. Also, the only way they can get some legitimacy is to win an actual vote and not someone in a black robe saying it’s so.

  2. I have talked with a couple of gays who (seriously!) articulated the sentiment “It’s our turn to be the oppressors now, you frakkin’ breeders!”
     
    These people stated, quite plainly, that one of their goals was to force churches to celebrate the wonderfulness of their sexual orientation, and they were ready and willing to sue to force Catholic churches (among others) to conduct gay weddings whether that violated anyone’s principles or not.

      1. Let me guess – a lot of bloodshed and that numerically puny minority getting almost eradicated?

    1. The Catholic Church will probably have a more militant element by the time they get around to suing them.

    2. Of course, they’re completely ignorant of the history of how the United States responds to would-be oppressors.

  3. i hope that 5-4 (or better) decision happens. the crying and whining will be joyful to behold.
