It totally *is* contagious. It’s just that it’s only contagious for telepaths… but if you’re a telepath (with whatever number of minds in your gestalt) and you telepathically encounter another telepath, then that’s it. Your’e sucked in.
By implication, you rapidly approach a state where there are three kinds of telepath in the world… The Worldmind, random individuals or small groupminds who are doing Whatever It Takes to *never* touch the worldmind, and individual telepaths who haven’t been discovered quite yet.
As for criminological implications? Oh, worse than that. There are *loyalty* implications. Absolutely nothing prevents two telepaths that are dedicated loyal to two different countries at war from merging with one another… and now every piece of information that the one had, the other now also has. If a telepath with a joint account (say, with their spouse) joins The Worldmind, and that spouse isn’t part of it? well, maybe that money *would* be better spent elsewhere. At the same time….
Basically, it gets *messy*.
